Use of User Generated Content

Water Creation Inc. (referred to as "We/Us/Our") may occasionally reach out to you (referred to as the "User") with the intention of seeking your consent to share Social Media Content (referred to as "Content") that has been posted. This Content is limited to what has been publicly posted on the User's social media platforms (referred to as "Platforms") and pertains to the products sold by our Company. Platforms encompass various social media platforms, including but not limited to Pinterest, Facebook, Instagram, Thread, TikTok, YouTube, and Twitter

License

The User hereby provides Water Creation Inc., along with its affiliates, subsidiaries, successors, and assigns, a non-exclusive license to reproduce the Content for the purpose of promoting our company and its products across all present and future media and formats, whether they are known or developed, online or offline. This includes utilization on any platform. In the event that the User is featured in the Content, they unconditionally grant permission for the use of their image, name, likeness, and voice within the Content

Represent and Warrant

When User creates or makes available any Content, User hereby represents and warrants that:

• The Creation, distribution, transmission, public display or performance, and the accessing downloading, or copying of your Content do not and will not infringe the proprietary rights, including but not limited to the copyright patent trademark, trade secret, or moral rights of any third party.
• User are the creator and owner of or have the necessary license, right, consent, releases, and permissions to use and to authorize Us to use User Content in any manner contemplated by the Services and these Legal Terms.
• You have the written consent, release, and/or permission of each and every individual person in your Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Content in any manner contemplated by the Services and these Legal Terms.
• User is at least eighteen years of age
• User Content does not violate any applicable law, regulation, or rule.

Copyright

The User acknowledges that the Content is free of any copyright infringement and hereby releases Us from any and all claims, demands, or liabilities related to invasion of privacy, infringement of the right of publicity, defamation (including libel and slander), and any other violations of personal and/or property rights.

Indemnification

The User hereby indemnifies Us and agrees to hold it harmless from any and all actions, claims, demands, lawsuits, losses, costs, damages, judgments, liabilities, license fees, settlements, or expenses incurred, obtained, or sustained, including, without limitation, attorneys' fees and costs, of any nature whatsoever, whether in law or equity, arising solely from questions about the identity and validity of the rights to the Content published by the User, particularly related to copyright infringement or misappropriation.

The User acknowledges and agrees that Water Creation Inc. and any associated platform shall not be held responsible or liable for any losses, damages, or injuries of any kind arising from our use of User Content in accordance with these Terms. The User hereby releases Water Creation Inc. and any associated platform from any liability, including that which may result from Our use of User Content in accordance with these Terms and Conditions
